Public Notice of Submission of an Application for a Municipal Waste Permit Application Resource Recovery Landfill Facility

On or about April 14, 2006, Resource Recovery, LLC (RRLLC) will file an application with the Pennsylvania Department of Environmental Protection (PADEP) for a permit to develop the proposed Resource Recovery Landfill (RRLF) in Rush Township, Pennsylvania. The proposed RRLF landfill, if permitted, will provide a waste disposal capacity of 40+/- million tons, which will allow for a 28-year landfill life, based on an average daily volume (ADV) of waste equal to 5,000 tons.

The proposed permit area will occupy 709.9 acres, all of which are located in Rush Township within the boundary of property equitably owned by RRLLC. The permit area will include, in addition to the landfill footprint, a soil borrow area, access roads, storm water management facilities, and ancillary structures.

The lined landfill footprint area will occupy approximately 274+/- acres. The proposed RRLF is located in Rush Township directly north of Interstate 80 (I-80) between the Snow Shoe and Kylertown exits. RRLLC will submit a point-of-access (POA) application to the Pennsylvania Department of Transportation to construct a dedicated interchange to access the site directly from I-80.

RRLF proposes to be permitted to operate on a 24-hour per day basis, Monday through Saturday, except for national holidays. RRLF may elect to begin its operations at some level less than a 24-hour basis, with notification given to haulers as the operating hours increase to 24 hours per day.

RRLF expects to initially accept approximately 2,000 tons per day for its first year of operation, increasing to an ADV of 5,000 tons per day during subsequent years. Its location, buffer areas, and setback distances make a 24-hour operation feasible without off-site effects.

RRLLC is proposing an improvement to the standard design with an alternative design for the leachate detection zone as provided for by Section 271.231 (relating to the equivalency review procedure). The alternative design will incorporate a geocomposite drainage material in lieu of aggregate. The design will meet all regulatory performance standards and has been successfully implemented at other Pennsylvania landfill facilities.

RRLLC is proposing an improvement to the standard design with an alternative design for final cover terrace configuration as provided for by Section 271.231 (relating to the equivalency review procedure). The alternative design will incorporate one 20-foot wide terrace for every 40 feet in elevation rise in lieu of 15-foot wide terrace for every 25 feet in elevation rise. The design will meet all regulatory performance standards and has been successfully implemented at other Pennsylvania landfill facilities.

RRLLC is proposing an improvement to the standard design with an alternative design for the particle size of protective cover material as provided for by Section 271.231 (relating to the equivalency review procedure). The alternative design will incorporate aggregate in the protective cover layer that is larger than _ inch in maximum particle size. The design will meet all regulatory performance standards and has been successfully implemented at other Pennsylvania landfill facilities.

Copies of the permit application will be available after approximately April 14, 2006 for public review and copying at the Northcentral Regional Office of the PADEP at 208 West Third Street, Williamsport, Pennsylvania between 8:00 am and 4:00 pm, Monday through Friday, and at the Centre County Planning Office in Bellefonte, Pennsylvania. The application will also be available for review at the Rush Township office at 150 North Richard Street in North Philipsburg between 9 am and 4 pm, Monday through Friday. Fees for copying may be charged.

Pursuant to PADEP regulations, host municipalities and counties may submit recommendations for permit conditions, revisions or approval or disapproval and other comments directly to the PADEP within 60 days of the PADEP's receipt of the subject application.
